Michigan's Texting-while-driving ban

As most Michigan residents already know, texting while driving is now officially illegal. The ban took place on July 1st. Motorists face a $100 dollar fine for the first offense and $200 dollar fine for the second offense. Michigan was the 24th state to create such a ban and there are currently 30 states with a similar texting ban.
With all the current cell phone and future cell phone technology, making a determination if a motorist was texting seems like a difficult proposition to me. Most smart phones have 100's of applications along with the lucrative options that already exist in the phone. How can you tell if someone is dialing a phone number, checking for information, or using their phone as a gps?
I completely agree that texting and driving don't mix. I can see other drivers texting and weaving on and off the road, but this ban is nearly impossible to enforce. So what is the solution? I'm not a technical cell phone designer but it seems to me that most newer phones have a gps capability. If you start moving over 5-10 mph, just disable the SMS texting feature. But what do I know?
I had a hard time finding any real data or statistics to evaluate the ban in the few months its been enacted. If you have had any experiences with the texting ban or would wish to comment please do so!
