Medical Marijuana Law Will Protect Employees

Senator Mark Leno of California is proposing a bill that will stop employers basing their hiring and firing decisions on medical marijuana and a positive drug test. Of course medical marijuana will still not be allowed during work hours or at the office/workplace, but this bill will allow medical users to continue their prescription without worrying about being terminated.
Currently, the precedent is set with a 2008 California Supreme Court decision. The Supreme Court decided employers had the right to fire an employee who failed a marijuana drug test. Gary Ross was fired from an electronics firm for a negative test and it turns out he is a registered medical user.
This case is very similar to the well known Wal-Mart case here in Michigan. I wrote a blog a few months ago asking "Can you be fired for using prescribed Medical Marijuana?" This is a case where a Wal-Mart employee with a brain tumor was using prescribed medicinal marijuana and failed a drug test. He was promptly fired for the test.
I think that Michigan should try to pass a bill similar to the one Senator Mark Leno is trying to pass. With the well known problems of the economy, everyone deserves a fair shot at a job as long as they do the job well.
