Medical Marijuana Privacy Provisions Upsetting Police
While doing some research about privacy and the newly formed Medical Marihuana Act, I came across a great news article. Although not in Michigan, the same problems are occurring here in our state. Basically police in New Mexico are coming across what they perceive as a large problem with the newly formulated
marijuana law and the privacy provisions that go along with it. They claim not knowing who is a legal grower/user from an illegal grower/user is draining their resources. The police are also worried about potential standoffs which need not happen and could result in injuries or even death.
The Michigan privacy provisions are very similar to other states and reads that the "MMMP (Michigan Medical Marijuana Program) does not give out lists of patients or caregivers. Law enforcement personnel may contact the MMMP only to verify if a patient or caregiver registration card is valid. The MMMP will tell law enforcement staff if the patient or caregiver is registered. The MMMP will disclose patient information to others only at the specific written request of the patient. MMMP computer files are secure and paper files are kept locked when not in use."
In my opinion, the privacy provisions are one of the most important elements in the Michigan Medical Marijuana Law. With the new program still looked down upon by some individuals and especially businesses, it is vital that the registry list stays confidential. If everyone had access to this list, many people who benefit from the medical benefits would shy away because of fear of others or most importantly fears of employers finding out. If my prescription medication is confidential why shouldn't
medical marijuana be confidential as well?
It seems to me that making a phone call to the MMMP before starting an investigation or using "important resources" isn't really all that difficult. I mean how hard is it to make a 2 minute phone call prior to an arrest or seizure?
