Should employer be responsible?

An interesting case is being heard this week in federal court in Detroit. It involves a fatal drunk driving accident and who should bear the financial responsibility. Thomas Wellinger, a former employee of UGS, is serving a 19-30 year sentence for killing Judith Weinstein and her two sons. The real question in this case is whether Thomas should be held responsible or should UGS, his employer, be held responsible. Thomas ended up killing a wife and 2 sons leaving Gary Weinstein with no family. A blood alcohol test revealed a BAC of .36%. The current legal limit in Michigan is .08%. Weinstein believes that UGS should be held responsible since Wellinger has had previous history with alcohol. UGS and other employees were aware of this situation and nothing had been done to correct the problem. It should also be noted that Weinstein never sued Wellinger directly, instead he chose to sue UGS. I will hold off my comments until there is a verdict. Please check back shortly for my update!
